Utilities Committee Meeting 11/07/2023 – Will Vote On Whether City Will Participate In PFAS Class Action Lawsuit

The Utilities Committee is meeting 11/07/2023 at 4:30PM.

They have two action items on the agenda.

The first is a request to approve a single source contract for stormwater consulting services to raSmith for the Lightning Drive extension project. raSmith has been working on the Lightning Drive project for several years so staff would like them to continue to work on it.

The committee will also have to vote on whether or not to participate in the PFAS class action settlement for 3M and Du Pont. If the city remains part of the lawsuit they could receive around $1,825,000 from the 3M settlement and $175,000 from the Du Pont settlement. Per the memo from staff, “These total amounts equate to about thirty-six (36) days’ revenue for the Utility. Should changes in PFAS regulatory standards require the Utility to add new infrastructure to its system, that would require $10s of millions in capital costs alone.”

As a result, staff is recommending that the city not participate in the class action lawsuit or receive settlement funds so as to preserve their ability to file a lawsuit of their own in the future should the situation warrant it.
