Alderperson Smith Withdraws Intoxicated Bartender Resolution

Resolution 1-R-22 which would have made it unlawful for bartenders to serve alcohol while intoxicated has been withdrawn by the resolution’s author, Alderperson Michael Smith (District 10).

The resolution had been discussed extensively at the 01/26/2022 Safety and Licensing Committee meeting. At the time there had been questions raised as to whether the resolution was necessary given the low rate of incidents, the availability of other tools to respond to disorderly and illegal behavior, and the fact that the city of Neenah, which has had a similar ordinance on their books since 2013, has never had to cite anyone under it.

The committee had expressed some openness to treating intoxicated bartending as a license violation rather than criminalizing it and voted to hold the resolution so that staff could conduct research and suggest revisions.

During the 02/23/2022 Safety and Licensing Committee meeting, Alderperson Smith withdrew the resolution prior to it being brought to the floor for discussion or a vote. Alderperson Chad Doran (District 15) indicated on his aldermanic blog that this was due to concerns staff had raised regarding enforcement.
