The Municipal Services Committee met 06/24/2024. Most of the meeting was taken up with discussion about the resolution to rescind No Mow May, but they did take care of some routine items as well, including a permanent street occupancy permit from Rise Apartments to install doors that would extend 4 feet over the sidewalk when opened and a request from Boldt pertaining to the Fox Commons Development to extend their street occupancy permit along College Avenue until August 15, 2024.
The committee voted unanimously to approve both requests.

RISE APARTMENT STREET OCCUPANCY PERMIT – This request was to allow the front doors to swing out over the public right-of-way/sidewalk which was necessary because the building is built right up to the lot line.
Alderperson Chad Doran (District 15) asked if this agreement was similar to the agreements the city had for storefronts along College Avenue. Public Works Deputy Director Pete Neuberger said that, yes, it was similar to the agreements they had for overhanging awnings and similar things on College Avenue.
The permit application included a letter from the applicant stating “This letter is to provide our word as a statement of good faith that we will work with the City to execute an Operations and Maintenance agreement with the City of Appleton in perpetuity for us as the owner to maintain the concrete stoops and the common joint between the stoops and adjacent City sidewalk per City standards.”
Alderperson Doran asked if this agreement was typical. Deputy Director Neuberger indicated it was and said it was similar to the agreement they had with the Urbane 115 development regarding the planters they had installed by their building. He said that, over time staff had learned about the maintenance needs of things that occupied the right-of-way and was now more cognizant of the need to have operation and maintenance agreements in place.
FOX COMMONS STREET OCCUPANCY PERMIT – This was an extension of the existing street occupancy permit related to the construction along College Avenue for the Fox Commons development. The original permit had already been extended once to end on 07/01/2024, but the work was not finished and Boldt needed to extend the permit to 08/15/2024.
Per Deputy Director Neuberger, “They’re working hard. They’re trying to get things done. But there’s a lot of stuff going on at the site. And this is their best estimate of what it’s going to take for them to occupy this this this area for an extended period of time.”
The committee approved both street occupancy permits by a vote of 5-0.
