Safety And Licensing Committee Approves Premise Amendment Allowing Restaurant To Use Shipping Container As Outdoor Bar

The Safety and Licensing Committee met 06/22/2022. One of the items they took up was a permanent premise amendment for the restaurant Area 509 that would allow them to add a shipping container to their premise so they could use the shipping container to serve alcohol to patrons.

Alderperson Alex Schultz (District 9) asked what effect approving this would have on the overall approval of the shipping container that the restaurant owner had installed at the location. Alderperson Schultz understood there had been some back and forth with the inspections department regarding that.

A staff member responded that the approval request before the Safety and Licensing Committee was to add the shipping container to the licensed premise. It was still contingent on approval from the Community and Economic Development Department, Health Inspection, and the police. She did not have an update on when those approvals would be completed. Her understanding was that there were plans that needed to be submitted and some engineering work that needed to be completed. She thought it would take some time, but they wanted to put this item on the agenda now so that when everything else was approved, it would be ready to go.

The committee voted 5-0 to approve the premise amendment request.

[As you may recall from the discussions about pole buildings that took place last year, shipping containers are prohibited on residential properties.

If this item is any indication, they are, however, apparently permitted on commercial properties, even ones that are right next to residential neighborhoods. I’m a little curious what the reasoning is behind allowing a commercial property to use a shipping container as an accessory building but not allowing residential property owners to use them as such.]
