Board Of Zoning Appeals Meeting 12/16/2024 – Will Take Up Variance Requests For Commercial Building With No Parking Lot, Residential Property With Code-Violating Driveway Extension

The Board of Zoning Appeals is meeting 12/16/2024 at 7PM. They will be taking up variance requests pertaining to two properties.

The first is a request for a property on Pacific Street. The Property is zoned commercial but does not have any off-street parking. The applicant would like to turn the property into a 15-person-capacity restaurant, but the Zoning Code requires 1 off-street parking space per 3 persons allowed based on maximum capacity. The applicant is asking for a variance to that requirement and notes “the building is functionally useless as a commercial space despite being built as one” if the variance is not granted.

Per the memo from Inspections Supervisor Kurt Craanen, the building is a non-conforming lot of record that cannot be used for its intended use without a variance; therefore, it has met the review criteria for a variance.

They will then be looking at two variance requests pertaining to a driveway on a residential property on Ballard Road. The homeowner installed a driveway extension that goes 10 feet into their front yard. The zoning code allows driveway extensions to go no more than 4 feet into the front yard. Additionally, the extension does not taper from the sidewalk in the way the zoning code requires.  The homeowner had hired a contractor to perform this were and were assured by the contractor that the plans for the driveway extension had been approved and were in compliance with city code. That, however, was not the case. They are now requesting a variance to be able to maintain work that has already been completed.

City staff do not believe the homeowner has met the requirements to be granted a variance.
