Board Of Zoning Appeals Meeting 06/19/2023 – Will Hear Variance Requests For Car Wash On Calumet, Lot Line Change For Residence On Memorial

The Board of Zoning Appeals is meeting 06/19/2023 at 7PM.

They will be taking up two variance requests.

The first request is related to the proposed car wash at 4029 E Calumet Street whose special use permit was recently approved by the City Plan Commission and the Common Council.

It appears that the owner believes that the only way to build a functional car wash tunnel on this site would be to locate it in the front yard; however, the Zoning Ordinance prohibits drive-through facilities in the front yard. Inspections Supervisor Kurt Craanen states in his memo to the board “Car washes are a permitted special use in the C2 zoning district. If a functional car wash cannot be placed on this lot in any other way, due to the limitations of the lot, the hardship criteria is met.”

The second request is related to a residential property on S Memorial Drive. The owner owns two properties that are side by side and wants to alter the lot line between them which will result in one property having a lot coverage of 55%, but the Zoning Ordinance limits lot coverage to 50%.

Per the memo from Supervisor Craanen, a pool was built on one of the properties without a permit. The accessory equipment and shed associated with the pool was built on the other property. The owner believes that they would not be able to sell either property now or in the future with the pool straddling the properties, hence the desire for a variance; however, per Supervisor Craanen, “The hardship in this case was created by the actions of the owner. Neither lot has a unique shape or dimensions.” He also notes that the proposed new lot line would “allow the setbacks for the pool to meet code standards and places the pool and the pool accessories on the same lot. The lot coverage cannot be met while still meeting other code standards.”
