City Plan Commission Approves ThedaCare Rezoning Request And Special Use Permit Facilitating The Addition Of 31 Additional Beds At S Heritage Woods Drive Residential Facility

The City Plan Commission met 06/28/2023. They took up two items related to ThedaCare’s community based residential facility at 2600 S Heritage Woods Drive. One was a request to rezone the property from a PD/R3 Planned Development Multifamily District to an R-3 Multifamily district and the other was a special use permit to allow them to increase the number of beds at the facility from 20 to 51. Both items were approved unanimously.

Public hearings were held for both the rezoning and the special use permit, but nobody spoke at them.

Principal Planner Don Harp explained to the Commission that ThedaCare currently runs a 20-bed community based residential facility (CBRF) at that location. They were looking to immediately add 8 additional beds and wanted the ability to add 23 more at some point in the future, bringing the total number of beds to 51.

When staff looked at the history files on this property and the plan development overlay on this property, they discovered that the implementation plan document had not been finalized or recorded. That document was what would have set the development standards for the property, but because it had not been recorded there were no development standards for the property and no development could occur unless there was some sort of zoning action proposed by the owner.

After discussing the situation with City staff, ThedaCare decided to rezone the property to an R-3 Multifamily district. That zoning already included the other primary uses on the property as principal uses, and ThedaCare could apply for a special use permit that would allow them to expand the CBRF on the property. City staff was recommending approval of the rezoning request.

The commission voted unanimously to approve the rezoning request and the special use permit application.
