Common Council Approves Special Use Permit For New Restaurant At Former San Rocco’s Location After Amending The Permit To Require The Owner Erect A Fence

The Common Council met 04/06/2022. There was only one item separated out for an individual vote. It was not one that I would have expected but was for Item 22-0347, a Special Use Permit #4-22 for restaurant with alcohol sales and service for the property located at 1025 N. Badger Avenue.

This property which is located next to a residential neighborhood has housed a number of short-lived restaurants, including an ice-cream shop (if I’m remembering correctly) and a pizza place.

The current owner wants to turn it into a Caribbean restaurant with indoor and outdoor seating and an outdoor bar.

Alderperson Michael Smith (District 10) was the one who requested that it be separated out. He explained that he had been in discussion with the owner and with the Planning Department and he wanted to amend the permit to include one more requirement in addition to the 6 that were already laid out in the permit.

He had prepared the language of the amendment ahead of time and had already provided it to the clerk. “Applicant shall construct a fence around the outdoor seating area that is adjacent to residentially zoned properties. Fence shall comply with section 23-44 of the zoning code, and applicants shall obtain required building permits.”

Alderperson Katie Van Zeeland (District 5) asked if they had done something like this before with special use permits.

Community and Economic Development Director Karen Harkness answered that, as in similar situations in the past, the applicant had agreed to put the fence in so it could become part of the special conditions for the special use permit. She said he had agreed to put in a fence before there had even been any discussion.

There were no further questions or discussion and the amendment and then the amended item were both approved by a 14-0 vote with Alderperson Alex Schultz (District 9) abstaining.
