Rezoning Request And Future Land Use Map Amendment For Maritime Tavern Approved By City Plan Commission

The City Plan Commission met 02/09/2022. They had two related action items on the agenda.

The first was a request to approve a Comprehensive Plan 2010-2030 Future Land Use Map Amendment for a parcel located at 1312 North Division Street from future One and Two-Family Residential land use designation to Mixed Use land use designation.

The second item was a request to rezone the parcels located at 1312 North Division Street and 336 West Wisconsin Avenue from R-1C Central City Residential District and C-2 General Commercial District to C-1 Neighborhood Mixed Use District.

Principal Planner Jessica Titel gave an overview of both items together, since they were related. Maritime Tavern is currently located on the Wisconsin Avenue parcel. The Division Street parcel had been a single family home that had recently been razed. Maritime Tavern wanted to use the parcel that had housed the razed property to expand their parking lot and create a patio addition. In order to do that, they needed to rezone the properties.

In conjunction with the rezoning request, they were also requesting to amend the future land use map designation for the property on Division Street to bring it in line with the designation for the parcel on Wisconsin Avenue. State statute requires zoning changes to be consistent with the comprehensive plan and the future land use map, which was why that request was being made in conjunction with the rezoning request.

She reported that staff reviewed the request against the zoning code and the comprehensive plan and recommended approval of both items.

The city was required to hold public hearing on each of the items, so Mayor Woodford decided to hold both public hearings before taking up either of the items for consideration.

Nobody wished to speak, so the commission took up the future land use amendment request.

Commissioner Dane wasn’t sure if his question belonged in discussion of this item or the other item. He wanted to know if there would be any buffering, such as fencing or landscaping, for the benefit of the residential neighborhood to the north.

Community and Economic Development Director Karen Harkness answered that parking lot buffering was requires. That would be reviewed at the time of the site plan, presuming the rezoning and future land use requests we approved. They would have to submit a full site plan and make sure they were meeting all the setback and landscape buffering requirements. That would be approved administratively, at the staff level, instead of coming before a committee.

Alderperson Denise Fenton (District 6) asked how many properties on Division Street received notices regarding the two items on the agenda that day.

Director Harkness didn’t have a map in front of her to know exactly how many houses it was sent to, but she did say the notification woukd have been sent to every property within 100 feet of the subject parcels.

Mayor Woodford noted that the Mayor’s Office had not received any comments or questions from the public regarding this item. He also had not heard from any alderpersons about it. He asked Director Harkness if the same held true for her.

She answered that she had received one phone call from a resident who had re eived a notice. She answered her questions and provided her a link to the meeting agenda a staff report. She had not heard anything since then.

There were no further comments or questions and the commission voted unanimously to approve the future land use map amendment.

They then moved on to the rezoning request.

Principal Planner Titel noted to the commission that this item would come before the Common Council on March 16 because there was a 30 day notification period required for comprehensive plan amendments. So this rezoning would take a little longer than typical rezoning takes.

The commission members had no questions or comments on this item and it was approved unanimously.
